Where on the footpath can outdoor dining occur?
Footpaths in the Cairns CBD are divided into Pedestrian Zone, Trading Zone and Kerb Zone (refer Figure 1 below). Footpath dining can take place in the Trading Zone which is the area that the Council allows for commercial activity.

What is allowed in the footpath trading zone?
Footpath dining and associated infrastructure, such as planter boxes, umbrellas, barriers and menu display stands, are permitted in the Trading Zone. The Trading Zone is the area that the Council allows for commercial activity.
To ensure clear pedestrian access to dining areas and shops, the sale of goods and a-frame advertising signage is not permitted.
All furniture associated with your footpath dining permit is only permitted to be on the footpath during opening hours. Furniture must be removed from the footpath when the business is closed.
If you wish to install a permanent structure in relation to footpath dining, for instance a deck, you will need separate approval. Please contact us on 1300 69 22 47 to discuss your options.
What could happen if I trade on the footpath without a valid permit?
Council can fine businesses that are trading without a valid footpath dining permit (either not holding a permit at all, or breaching conditions on your permit).
Businesses may also have their outdoor dining furniture seized by Council in accordance with Cairns Regional Council Local Law No. 1 (Administration) 2016 [Link to local laws].
Where do I display my footpath dining permit?
Permits for footpath dining must be clearly displayed on the shop front window.
