Building Services

Regulation

The Building Regulation unit provides a range of necessary services. The services are mainly for the building and development industry. Services include the following:

  • Discretionary assessments under the provisions of the Building Act 1975. These include siting of buildings, amenity and aesthetics assessments, swimming pool fencing variations.
  • Compliance searches and other property searches relating to building development.
  • Provision of a property information service, with extracts from Council's records, including:
    • Date and original cost of building
    • House drainage plans
    • Location of sewers
    • Copies of drawings
  • Registration of building certifications.
  • QA checks of developments to ensure that Council's interests and requirements of applicable legislation (other than the building certification) are being addressed.
  • Provision of building statistics to the Australian Bureau of Statistics and to Council.
  • Enforcement functions under provisions of Building Act.

Core Responsibilities

Building Regulation Service exists to:

  • Undertake a partnership role in regulatory, policing and enforcement provisions of the IPA / IDAS Development Approval Process within the Cairns Local Government area, within which the Cairns Regional Council is the Assessment Manager.
  • Undertake regulatory and enforcement functions under the provisions of the Integrated Planning Act, the Building Act and Sewerage and Water Supply Act.
  • Provide a property information service; specifically information affecting building development.
  • Carry out Community Service Obligations on behalf of the Council, where related to building development.

In order to address its core responsibilities, Building Regulation Service must also undertake other corporate responsibilities. They include:

  • Partnership involvement in corporate activities and issues
  • Workplace safety
  • Legal compliance
  • Training
  • Financial management

In addition to its core responsibilities, Building Regulation Service also provides other services to Council and its customers. They are:

  • Undertake a partnership role with Government, Local Government and Private Sector entities in the review and development of building legislation and standards.
  • Compile and provide building statistics to the Australian Bureau of Statistics, Council and customers
